PRIVACY POLICY

 

The website https://www.tescagroup.com/ is hereinafter referred to as the “Site”.

The “user” means a web user who connects to and uses the Site.

The purpose of this Privacy Policy (the “Policy”) is to inform users of the use that the TESCA GROUP makes of the personal data gathered on the Site (the “Personal Data”), in compliance with French Law No. 78-17 of 6 January 1978 on computers, databases and civil liberties, as amended, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (referred to together as the “Applicable Regulations”).

The Policy may be amended at any time by TESCA GROUP, in particular for the purpose of complying with any regulatory changes or technical developments. Users must therefore always refer to the latest version of the Policy before browsing or using the Site.

 

  1. Controller of the processing and purposes

The user may consult this Site and its content without communicating the slightest personal information. However, in order to contact TESCA GROUP or apply for job offers, the user must provide personal information concerning him- or herself. The processing carried out is based on the user’s consent or is necessary for the conclusion or performance of the contract.

The controller for the processing of Personal Data is TESCA GROUP, a société par actions simplifiée (simplified form limited company), registered in the Trade and Companies Register of Nanterre under the number 342 545 456, with a registered capital of €796,566.60, having its registered offices at Tour Pacific – 11 cours Valmy – 92977 Paris La Défense – France.

 

  1. Purposes and legal bases

The Personal Data is processed for the following purposes:

– Making the Site and associated services available to users, ensuring their proper working, processing user requests, etc. => Contract between the user and TESCA GROUP (this Policy and the terms of use of the Site)

– Improving the Site and associated services, particularly to optimise or offer new functionalities, or to allow users to enter data in a simplified and automatic manner => Legitimate interest of TESCA GROUP in improving the Site and the associated services.

 

  1. Collected data and period of storage

At the time the Personal Data is collected, the user will be informed if certain items of Personal Data must mandatorily be entered or if they are facultative. If mandatory items of Personal Data are not provided, access to and the use of certain of the Site’s functionalities, such as the service for contact and candidacy for TESCA GROUP job offers, will be impossible.

In the context of the aforementioned purposes, TESCA GROUP will collect, process and store the following Personal Data:

– identification data, including surname and forename;

– contact data, including e-mail address and telephone number;

– data concerning the professional career, when applying for job offers;

– the position and name of the undertaking represented by the person completing the contact form;

– technical data concerning browsing and interaction, including frequentation statistics, IP address, cookies, the pages consulted by the user, the date and time of consultation.

Users’ Personal Data will not be stored for longer than the period strictly necessary for the pursued purposes, in accordance with the Applicable Regulations. In particular, the Personal Data gathered to:

– manage candidate applications will not be kept for more than 2 years following the sending of the application, and in cases where the candidacy is unsuccessful;

– responding to contact requests from users are not kept for more than 3 years as of the time the data was collected or as of the date of last contact.

 

  1. Recipients

This information may be communicated to subsidiaries of TESCA GROUP within or outside the European Union, in order to respond to the user’s requests. In the event that the Personal Data is transferred to a subsidiary of TESCA GROUP located in a country that does not provide appropriate safeguards for the protection of the Personal Data, standard contractual clauses will be put in place and will be accessible on request under the conditions set out in Clause 6.

These Personal Data may be transferred to any entity which comes to acquire TESCA GROUP.

TESCA GROUP undertakes not to publish without the user’s knowledge, exchange, transfer, sell, assign or rent the Personal Data on any medium whatsoever.  

 

  1. Cookies

Among the Personal Data, TESCA GROUP will collect data resulting from the saving of cookies. The user is informed that when he or she visits the Site, one or more cookies may be automatically installed on his or her computer (subject to his or her consent, if applicable). A cookie is a small file which does not provide for the identification of the user, but which records information concerning a computer’s browsing of a site.

TESCA GROUP only uses Google Analytics cookies for Site audience measurement.

The data collected using the cookies provided by TESCA GROUP are stored for a maximum period of thirteen months.

Subject to an express request and subject to providing TESCA GROUP proof of his or her identity, the user has a right of access, modification, rectification, erasure and the right to object with respect to his or her Personal Data. The user also has a right to portability of his or her Personal Data and the right to give TESCA GROUP instructions as to the fate of his or her Personal Data after death. Contact and complaints

For any request or in the event of dispute between TESCA GROUP and users concerning the processing of their Personal Data, users may address their claim or complaint to TESCA GROUP at the postal address: 11 cours Valmy – 92977 Paris La Défense – France. TESCA GROUP shall endeavour to find a satisfactory solution to ensure compliance with the Applicable Regulations. If TESCA GROUP does not respond or if the dispute persists despite a proposal from TESCA GROUP or at any other time, users have the right to bring a complaint before the French data protection body (CNIL) or the supervisory authority of the Member State of the European Union in which the user habitually resides.
